Volotea Denied Boarding Compensation

How much is flight overbooking compensation? Rules? How to get it?

Often airlines sell more tickets than there are seats on the plane. This is called ‘overbooking’. Airlines overbook their flights to ensure that there are no empty seats at take off. Overbooking of flights is a common practice, and Volotea is not an exception. But what if everyone shows up? Then some passengers has to be denied boarding due to overbooking. Whenever that happens, the airline has to pay EU denied boarding compensation.

There are two ways you can claim this compensation.

1. Volotea Overbooking Compensation: EU Denied Boarding Regulations

Have you been denied boarding by Volotea? 

Are you protected in the event of denied boarding? What are your rights? 

In Europe, passengers are protected in the event of denied boarding. Airlines have to provide certain services for free to the affected passengers. In some cases, compensation has to be paid, too.

If you’re flying to or from Europe with Volotea, and you are involuntarily denied boarding due to overbooking — you are entitled to flight overbooking compensation (EU denied boarding compensation) up to €600.

This only applies to overbookings.

If you are denied boarding due to some other issue (like expired, or soon-to-expire, passport, or no visa), you won’t get any compensation from the airline. If you are denied boarding voluntarily (voluntarily give up your seat), you can’t get compensation either.

1.1 Voluntary Denied Boarding

What is voluntary denied boarding?

Yes, there are different types of denied boarding. 

Your flight is overbooked. The airline has sold more tickets than there are seats on the plane. But, unfortunately, everyone shows up for their flight. There are not enough seats. 

First, the airline will look for volunteers who will give up their seats and travel later, on a different flight. You too might be asked to give up your seat in exchange for a new flight and instant compensation in the form of vouchers or cash. If you are offered compensation like this and you accept it, it’s called voluntary boarding denial.

In this case, you aren’t entitled to denied boarding compensation from Volotea.

You don’t have to agree to an offer like this.

1.2 Involuntary Denied Boarding

There are situations when passengers don’t have a choice.

Your Volotea flight is overbooked, but there are not enough volunteers. And there are not enough seats. So the airline might bump some passengers involuntarily. If this happens to you, know that it’s called involuntarily denied boarding, and you are eligible for compensation.

What happens in case of involuntary denied boarding?

  • The airline must provide you with a new flight;
  • The airline must refund you fully if you decline the new flight;
  • In addition to that, you are entitled to receive care from the airline*;
  • You are entitled to compensation up to €600 per passenger. 

* Volotea must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If you have to wait overnight, Volotea must provide you with free accommodation and free transfer from and to the airport.

1.3 Right to Care

All passengers travelling with Volotea have a right to care.

If you have to wait at the airport for a new flight, you have a right to receive care. For example, if you are denied boarding, or if it’s a last-minute cancellation or a long delay, and you have to wait at the airport at least 3 hours.

Including flight disruptions caused by extraordinary circumstances.

What does it mean for you as a passenger?

Volotea must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If your flight is on the next day, the airline has to book you into a hotel for free. The airline also has to provide a free transfer.

Agreeing to these free services doesn’t affect your chances of getting compensation.

2. How to Claim Volotea Flight Compensation? How to Claim Flight Overbooking Compensation?

You can claim compensation yourself.

Keep in mind that it’s not a fast process. Usually it takes time for the airline to get back to the passenger and pay compensation. Often airlines wrongly deny compensation claims. You need to be persistent when claiming compensation yourself.

2.1 How Long Does It Take?

It could take 2-3 months.

It could take more. Most people receive compensation in a few months.

Don’t be surprised if it takes time. Most airlines don’t want to pay compensations, and they are not really cooperative. It could take a few months, several reminder emails and other additional steps until you receive your Volotea overbooking compensation.

If the airline refuses to pay compensation, it is necessary to take the case to a national enforcement body or court. All of it takes time.

3. How Much Can You Claim?

In the EU compensation amounts are fixed.

In most situations they range from €250 to €600.

Here is how you can calculate Volotea compensation yourself:

When your destination is within the EU/UK:

€250

If the distance of your flight is
up to 1,500 km

€400

If the distance of your flight is between 1,500 – 3,500 km

When your destination is outside the EU/UK:

€250

If the distance of your flight is
up to 1,500 km

If the distance of your flight is between 1,500 – 3,500 km

If the distance of your flight is more than 3,500 km

This the amount you should be demanding if you are claiming compensation on your own. Volotea might offer you smaller compensation. You don’t have to agree to anything less than you are entitled to. The compensation amounts are regulated by the EU law, not airlines.

There’s one exception. When the flight distance is 3500+ kilometres and you reach your destination 3 to 4 hours later than planned, you are entitled only to 50% of the compensation amount (that means €300, not €600).

3.1 Volotea Voucher Code, Discounts or Cash?

According to the law, compensations have to be paid in cash or by bank transfer.

Volotea, just like most airlines, might initially offer you a voucher refund or voucher compensation instead of money. You can request a bank transfer instead. Because all airline compensations and refunds in the EU have to be paid in cash or by bank transfer.

Volotea Denied Boarding Compensation: FAQ

My Volotea flight was very cheap. Are passengers with cheap tickets entitled to compensation?

Yes, absolutely.

As long as your Volotea flight is eligible to compensation, all affected passengers can get compensation. The price of the ticket doesn’t matter.

Do I need to have travel insurance in order to claim compensation?

No, you don’t. 

When claiming compensation, you don’t have to provide travel insurance papers. You don’t even have to have insurance. However, we would recommend buying insurance next time when you travel. It can come in handy if your travel plans change or if you have a medical emergency (we really hope you won’t).

Can my child get compensation from Volotea?

Yes.

If you are entitled to compensation, your child will be, too.

Babies with a special infant ticket also can get compensation.

Can I claim compensation for another person?

Yes, you can.

You can claim flight compensation for a friend, relative or family member. Even if you weren’t on that flight yourself.

They will need to provide their boarding pass and passport copy and sign some documents Volotea or a flight compensation company might ask to sign.

How far back can I claim compensation?

Can you claim compensation for old flights?  Is there a deadline?

It depends on the laws of the country. In many countries in Europe, you can claim compensation even for old flights (2-3 years back). However, for the best results, we would recommend you to make a claim as soon as possible.

What to do if Volotea is refusing to pay compensation?

Volotea is refusing to pay compensation even though you are entitled to it. 

Unfortunately, airlines do this quite often. Can you still get compensation from Volotea? What to do in such a situation?

There are two ways how you can proceed. The best way is to hand over your case to a flight compensation company. They will continue pursuing compensation on your behalf. Alternatively, you may contact the respective national enforcement body and ask them to help solve your case. There are national enforcement bodies in all the EU Member states.

Problems With Visa or Passport

I was denied boarding due to issues with my visa / passport. Am I entitled to compensation?

No, you aren’t.

If you are travelling with a passport that is about to expire, or you don’t have a valid visa, you will be denied boarding. But you can’t get compensation from the airline in this case. This was your fault, and the airline doesn’t have to compensate you in such cases.

EU – Non-EU Flights, Tourists

I’m flying to the EU from a country outside the EU. Can I get compensation?

Is it a Volotea flight?

If yes, then you can (as long as the flight is eligible).

When your Volotea flight is departing from a country outside the EU, you are protected under the EU Flight Compensation Regulation 261/2004.

I’m flying from the EU to a country outside the EU. Can I get compensation?

Is it a Volotea flight?

If yes, then you can (as long as the flight is eligible).

On all Volotea flights you are protected under the EU Flight Compensation Regulation 261/2004.

I am not a EU/UK/EEA citizen. Can I get compensation?

Yes, absolutely!

According to EU Flight Compensation Regulation 261/2004, every passenger is protected. The nationality of a passenger doesn’t matter.

Other Situations

Volotea provided me with a free hotel stay and a free replacement flight to my destination. Can I still get compensation?

Yes (as long as the flight is eligible).

It doesn’t affect your chances of receiving compensation. 

Volotea took me to my destination. Can I still get compensation?

You might.

If you arrived at least 3 hours later than scheduled, and the disruption was due to the airline’s fault, you might get compensation. Even if you were given a new ticket to your destination, and received a free hotel stay.
